Typical Licensing Agreement

The agreement that we ask our authors to sign follows. This agreement is available in the public domain.

The volume of the Michigan Law Review in which your article will appear includes a statement of copyright advising that, unless otherwise provided, articles in the volume may be copied for educational use under the following conditions: (i) copies are distributed at or below cost; (ii) the author and the Michigan Law Review are identified; (iii) prior notice of the use is given to the Michigan Law Review Association in any manner desired by the Review; and (iv) proper notice of copyright is affixed to each copy. You agree to permit such copying, and you agree to assign to us the nonexclusive right to allow copies of the article to be made for educational use in the manner provided above.

If you do not wish the Review to permit such copying, you must notify the Review by <date> so that your article can be printed with the appropriate copyright information.

The Michigan Law Review Association has granted several electronic database companies, including Mead Data Central, West Publishing, and JSTOR, the right to reproduce and distribute each volume's contents. Accordingly, you hereby assign to the Michigan Law Review Association the nonexclusive right to authorize the above database companies and other present or future database companies to reproduce and distribute your article. You also hereby assign to the Michigan Law Review Association the nonexclusive right to publish the article on the Michigan Law Review website.

You agree to assign to the Review the right to transfer or sublicense the rights granted in this agreement.

You agree to abide by the deadlines set by the Michigan Law Review and any agreements made as a condition of acceptance. This includes:

Refraining from alterations at any point in the process that would increase the length of the article by more than ten percent of its original length.

Not publishing your article, or any version or derivative work thereof, in any other journal, book, or other format, whether print or online, until after your article has appeared in print in the Michigan Law Review without express written permission from the Review. This agreement does not, however, preclude your submitting your article to the Social Science Research Network Electronic Library at any time, whether before or after its publication in the Michigan Law Review. It also does not require you to attribute first publication to Michigan Law Review should you republish your work at a later date.

By signing this agreement you represent that you have full power and authority to enter into this agreement and to grant the rights described above. You further warrant that this grant does not infringe the copyright of another.
